Copyright Infringement Policy (DMCA)

Chatsifieds.com respects the intellectual property rights of others. We are committed to responding to valid claims of copyright infringement in a timely and effective manner. This policy outlines our procedures for a copyright owner to request the removal of infringing content and for a user to submit a counter-notice if they believe content was removed in error.

This policy is based on the principles of the Digital Millennium Copyright Act (DMCA) of the United States, which provides a widely-recognized framework for online copyright enforcement. While the DMCA is a U.S. law, its “notice and takedown” and “safe harbor” provisions are followed by online service providers globally.

1. How to Submit a Copyright Infringement (DMCA) Takedown Notice

If you believe that your copyright-protected work has been posted on our website without your authorization, you may submit a DMCA Takedown Notice to our designated Copyright Agent.

Please email your notice to [email protected] with the subject line “DMCA Takedown Notice” and include the following information:

  • Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
  • Description of the Copyrighted Work: A clear and detailed description of the copyrighted work that you claim has been infringed. If multiple works are involved, you may provide a representative list.
  • Location of the Infringing Material: A specific URL or links where the allegedly infringing material is located on our site.
  • Statement of Good Faith: A statement by you that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy and Authority: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf.
  • Signature: Your physical or electronic signature.

Upon receipt of a valid notice, we will investigate the claim and take whatever action we deem appropriate, which may include removing the content.

2. How to Submit a Counter-Notice

If you believe your content was removed by mistake or misidentification, you may submit a Counter-Notice. This is your opportunity to challenge the takedown claim.

Please email your counter-notice to [email protected] with the subject line “DMCA Counter-Notice” and include the following:

  • Your Contact Information: Your full name, mailing address, telephone number, and email address.
  • Identification of Removed Material: A description of the content that was removed or to which access was disabled and the URL(s) where it appeared before it was removed.
  • Statement of Good Faith: A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., that you consent to the jurisdiction of the U.S. District Court for the Central District of Victoria, Australia) and that you will accept service of process from the person who provided the original DMCA notice.
  • Signature: Your physical or electronic signature.

If we receive a valid counter-notice, we will forward it to the original claimant. Unless the claimant files an action seeking a court order against you within 10-14 business days, we may, in our sole discretion, replace the removed content.

3. Repeat Infringer Policy

Chatsifieds.com will terminate the accounts of users who are determined to be repeat copyright infringers. A repeat infringer is a user who has been notified of infringing activity more than once and/or has had user-generated content removed from the site on more than one occasion.

We reserve the right to determine what constitutes a repeat infringer and to terminate the account of any such user without prior notice.
